THIS TERMS AND CONDITIONS OF SERVICE is an AGREEMENT (“Terms and Conditions”, “Terms of Service”, “Our Policies”) between PURPLETRIANGLE COMMUNICATIONS (“We”, “Us”, “Our”) and CUSTOMER (“You”, “Your”) and applies to Customer’s account(s) with Purpletriangle Communications.
Your purchase or use of our products or services implies that you have read and accepted these terms and conditions.
Please note that the information contained herein is subject to change without notice. Customer agrees to periodically consult Purpletriangle Communications website (https://www.purpletriangle.info) for changes or amendments to this Terms and Conditions.
Purpletriangle Communications is not under obligation to provide notices of any amendment, modification or update of this Terms and Conditions to Customers.
GENERAL
Purpletriangle Communications is dedicated to providing value-added web designing, web and email hosting services, and we have a responsibility to protect and provide each Customer the best services available.
Purpletriangle Communications agrees to perform these services, subject to availability, and upon complete payment by the Customer of the specified amount.
DISCLAIMER
We will not be responsible for any damages your business may suffer for using our service. We make no warranties of any kind, expressed or implied for services we provide. We disclaim any warranty, merchantability, or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by our providers, us and our employees.
ACCEPTANCE
Use of any or all of our services constitutes acceptance of these terms and conditions.
We reserve the right to add, delete, or modify any provision of our policies at any time without notice.
WEB & EMAIL HOSTING
We reserve the right to suspend or cancel any customer’s access to any or all services provided by us when we decide that the account has been inappropriately used or otherwise.
SERVER USE
Personal accounts are to be used by the primary owner only, account holders are not permitted to resell, store or give away Web/Email hosting services of their website to other parties. Web/Email hosting services are defined as allowing a separate, third party to host content on the owner’s web site. Exceptions to this include ad banners, classified ads, and personal ads.
We reserve the right to refuse service and/or access to our servers to anyone.
We do not allow any of the following content to be stored on our servers:
Illegal Material – This includes copyrighted works, commercial audio, video, or music files and any material in violation of any Federal, State or Local Government regulation.
SPAM and Unsolicited Commercial Email (UCE) – We take a zero tolerance approach to the sending of Unsolicited Commercial Email (UCE) or SPAM over our network. Very simply this means that customers may not use or permit others to use our network to transact in UCE. Customers may not host, or permit hosting of, sites or information that is advertised by UCE from other networks. Violations of this policy carry severe penalties, including termination of service.
Violation of our SPAM policy will result in severe penalties. If a customer is found to be in violation of our SPAM policy, we will at our sole discretion, restrict, suspend or terminate customer’s account. Further, we reserve the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. We will notify law enforcement officials if the violation is believed to be a criminal offense.
First violation of this policy will result in an “Administrative Fee” of N30,000.00. A second violation will result in an immediate termination of your account and “Administrative Fee” of N50,000. Users who violate this policy agree that in addition to these “Administrative” penalties, they will pay “Research Fees” of N30,000 that our personnel must spend to investigate the matter. PLEASE, DO NOT SPAM from your account.
As our Customers are ultimately responsible for the actions of their clients/staff over our network, it is advisable that Customers develop a similar, or stricter, policy for their clients/staff.
Warez – Includes pirated software, emulators, freaking, hacking, password cracking, IP spoofing, etc., and encrypting of any of the above. It also includes any sites which provide “links to” or “how to” information about such material.
BACKUPS
Although we take daily backups of our servers, there is no guarantee that your information will be kept and up to date. It is strongly recommended that you take backups of your account also.
HIGH RESOURCE USER POLICY
You can run any CGI and non-CGI scripts you desire, however we reserve the right to disable any script that dramatically affects server performance.
Resources are defined as bandwidth and/or processor utilization. We may implement the following policy to our sole discretion:
When a website is found to be monopolizing the resources available, we reserve the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers.
PAYMENT POLICIES
All accounts are set up on a prepay basis. Although we reserve the right to change prices of accounts or services at any time, all pricing is guaranteed for the period of prepayment.
Payment is due each anniversary year or month following the date the account/domain name was established.
In situations where the customers fail to pay or declined payment for whatever reasons, we will immediately suspend or terminate the services until all outstanding debt is cleared.
In addition, we reserve the right to suspend or terminate our services until all outstanding debt due to us is cleared. The customer is responsible for all money owed on the account from the time it was suspended to the time of reactivating a suspended account (due to non-payment problem).
A N50,000 reactivation fee must be paid for each suspended or terminated account.
RENEWAL NOTICES
We are not under any obligations to send renewal notices or invoices either by email or by regular mail. In the event that we decide to send renewal notice or invoices, it will be sent directly to customers via e-mail shortly before or after the expiry date.
PAYMENT OPTIONS
In order to streamline our accounting procedures and keep costs down we accept Bank Transfers, Cheques and Cash payments.
CANCELLATION AND REFUNDS
We reserve the right to cancel the service at any time.
Customer refund requests are to be sent to mail@purpletriangle.info OR by registered mail to: PURPLETRIANGLE COMMUNICATIONS, PO BOX 4188 ENUGU. All mails sent by customers whether sent by NIPOST (Postal Mails) or sent by courier services are at the customers’ risk.
Refund requests will be declined if it is made for any cause outside our control.
Examples of causes outside our control include:
- Domain transfer or renewal failure.
- Failure of any third party programs that’s not supported by us.
- Failure of any outsourced service that is not directly provided by us.
- Customers lack of experience in dealing with web basics and communication protocols
ENTIRE TERMS AND CONDITIONS
This Terms and Conditions represents the entire Agreement between the parties, and supersedes all previous representations, understandings or Terms and Conditions. If any provision of this Terms and Conditions is held by a court of competent jurisdiction to be invalid, unenforceable, or void, the remainder of this Terms and Conditions will remain in full force and effect.
Customer hereby represents that he, she or it, is either an individual entering this Terms and Conditions for his or her personal use and is over 18 years of age, or is a corporation, other legal corporate entity, duly organized, validly existing and in good standing under the laws of Nigeria and the person acting on behalf of Customer is duly authorized to accept, execute and deliver this Terms and Conditions on behalf of Customer.
The laws of Nigeria shall govern these Terms and Conditions.
